General terms of use

1. Purpose

These terms govern the use of the site kazendra.com, an information service that gathers promotions published publicly by European merchants and links to their sites.

Browsing the site constitutes acceptance of these terms, in the version in force at the time of the visit. If you do not accept them, you need only leave the site.

2. What the site is, and what it is not

The site is a free information service and a connecting intermediary.
The site is not a seller. It takes no orders, collects no payment and is not a party to the contracts concluded with the merchants.
The contract of sale, the legal guarantee, the right of withdrawal and after-sales service fall exclusively to the merchant, not to Kazendra.

3. Access to the service

The service is provided free of charge and "as is". No permanent availability is guaranteed : the site may be interrupted, modified or shut down, in particular for maintenance or for an external cause (host, network).

Some functions — account, favourites, settings — are local to the device. They are neither synchronised, nor recoverable on another device, nor restored by the publisher in the event of the browser data being cleared.

4. Accuracy of prices and information

Prices, discounts and availability come from merchant sites and change at any time. The date on which they were recorded is displayed on the site.

Only the price displayed at the merchant at the time of purchase is authoritative. A discrepancy may exist between what the site displays and what the merchant applies, without this constituting a commitment by the site.

Where an offer is not denominated in euros, it is displayed in its original currency, without conversion : the site neither applies nor maintains any exchange rate. The final price depends on the merchant and, where applicable, on the buyer's bank.

5. Links to merchants

Outgoing links may be affiliate links : a commission may be paid to Kazendra when the purchase takes place after a click, without changing the price paid.

6. Fair use

You undertake not to :

extract the site's content on a massive scale in an automated manner without written authorisation ;
attempt to circumvent, damage or overload the service ;
reproduce the site's content in whole or in part without authorisation ;
use the site for unlawful purposes or to mislead a third party.

7. Intellectual property

The code, structure, texts, visual identity and logo are protected. The building of the catalogue is protected under database rights. See the legal notice for the details and for the trade mark.

8. Liability

Kazendra uses reasonable means to ensure that the information published is accurate and dated. Its liability cannot, however, be incurred :

in the event of inaccurate or outdated information coming from a merchant ;
in the event of interruption, suspension or misuse of the service ;
by reason of the content of the merchant sites to which the site links ;
in the event of loss of the local data (account, favourites, settings) following a browser wipe or a device failure.

Nothing in these terms limits the rights that the law recognises for consumers, nor exempts them from the liabilities that the law does not permit to be waived.

10. Changes to the terms

These terms may be modified, in particular in the event of changes to the service or to the law. The applicable version is the one in force at the time of the visit, and the update date appears at the top of the page.

11. Applicable law and disputes

These terms are governed by Belgian law.

In the event of a difficulty, first write to the contact indicated in the legal notice. Failing an amicable solution, a consumer in Belgium may refer the matter to the Belgian Consumer Mediation Service, Boulevard du Roi Albert II 8, 1000 Brussels — mediationconsommateur.be — or, from another country of the Union, to the European Consumer Centre of their country.

These terms are published in three languages: French, Dutch and English. In the event of any divergence of interpretation between them, the French version shall prevail, being the language in which they were drafted.
